We dont like Terms and Conditions! but to comply with UK regulations we have had to produce those as written below. Other terms may apply from time to time but may be in other links within the web site which relate to offers, promotions, customer accounts, news letters, vouchers, loyalty points etc.
The Terms as shown below are for a guide line for us to follow.
Clause 1
By placing an order "online" (Via an internet connection) with MDR Direct Online Retailing you are confirming that you have read, understood and agree to these Terms and Conditions and by registering with this site you are deemed to be accepting these Terms and Conditions and any thereafter amendments to these Terms and Conditions as required from time to time by British, European or International Law and or Financial institutions supplying services to us.
Please note you are free to navigate our sites as many time as you wish without the need to register your self as a user of our sites. For details can be read about the advantages of being a registered user of this site and we ask you to read the following links "How to use this site" and " Do I need an Account?" which you can see on the fron page of MDR Direct Online Retailing in the INFORMATION block.
Clause 1A
Online orders are processed by our online support team. All communication between the person placing the order and us whether by email, phone, fax or any other communication method will be undertaken in English only (our site do operate translations which we give you to assist you). It is important and your responsibility that you correctly fill out your email address when asked to do so when open your Customer Account for the first time. Failure to supply a correct or valid email address will result in automated or manual emails not being received by you. In such cases we will invoke clause 4 of these terms as required. If you wish to contact the online support for any reason - please email the online support at - online-support@keaygroup.com Due to anti-identity fraud measures we regret that unless you quote email address, Name and address and invoice number we may not be able to reply to your enquiry. Online support will look into your enquiry and will normally reply to you within 60 hours or sooner, where online support needs to contact our suppliers or trace a missing shipment a reply may take longer.
Clause 1B
Prices are valid at the time of placing the order online and are valid for online transactions only, but are subject to change without notice. Although we make every effort to ensure advertised prices are correct, there may be occasions where an incorrect price is advertised. Under these circumstances we are not obliged to supply goods at the advertised price where there is an error in any said price (a full refund of any funds submitted to us will be undertaken by us). Please note that prices advertised are UK VAT- inclusive and any customers ordering to non-European Union destinations will automatically have the UK VAT removed from their shopping Cart. Literature is not subject to UK VAT and therefore the non-EU price is as shown. Shipping charges are correct at time of placing your order. If Free shipping is offered this will only be for Orders for delivery to a UK mainland Address. Whilst we try our best not to surcharge orders please note the following important information; orders received by us for delivery outside of the European Union will be subject to additional shipping charges depending on service used - Royal Mail Registered for under 2kg - DPD over 2 kg weight or by volume/Cost which ever is higher, a standard invoice for additional shipping charges will be raised on day of shipping or within 28 days from the shipping date. No prior notice will be given to the customer but a standard invoice will be sent to the customer. (often the case with orders containing starter sets and or track which are heavy and large to ship) (please note that the Online shop Wroclaw Model Centre, keay.pl applies current Polish VAT regulations. As such no VAT will be deducted from their shopping Cart, VAT is also calculated at the rate of 22% Wroclaw Model Centre operates their own Online Terms & Conditions applicable to Polish Law).
Clause 2
Please note that MDR direct Online Retailing now advises what items are in stock or for order. Where an item is over ordered the item will be supplies as quickly as possible. Delivery maybe subject to your country's customs and excise clearance system and the delivery service within your own country. New release items that have been ordered will be supplied as soon as such items becomes available (payment in full or a deposit may be required at the time of placing such order). Any item (s) on back order can be cancelled at any time and a full refund for that item will be made where payment has been received by us, with the exception of items that have been specially ordered or built and or spare parts (inclusive of Motors, Bulbs, Brushes & Springs, Tyres, Transfers Couplings, Sub-Components, Digital Spares, Wire and Catalogues, which cannot be cancelled or returned for credit, replacement or exchange. Orders placed and part delivered are not returnable for refund if the balance of the order is cancelled by us or the customer as a result of the outstanding article (s) being no longer available or are deemed discontinued or removed from sale for other trading reasons. We reserve the right to cancel any order whether supplied or otherwise without giving any notification to the customer. As a requirement of EU Employment law we are required to protect our staff from customer abuse any such abuse from any customer may result in us automatically canceling any order (s) pending and or placed in the future. Customers who have opted to collect their order must present the Credit/Debit Card as recorded on the order, together with a valid Driving License or Utility Bill bearing your FULL NAME and CURRENT ADDRESS details as shown on the order. Without the above formal Identification we will not be able to release the goods to you. You will be advised by email when your order is ready for collection. For normal retail opening hours see keaygroup.com (# working Day is Monday, Tuesday, Wednesday, Thursday and Friday excluding any UK Public Holidays).
Clause 3
Full payment must be made at the time of ordering using payment methods of either: Visa/ Delta, MasterCard, Switch, Electron, Solo, American Express and or Maestro. We do not accept payment by Diners Club and some debit cards may not be useable for online internet transactions. If it is not possible to use a credit or debit card please print off your order and send it to us. We no longer accept Postal Orders.
Clause 4
For security reasons and our own internal requirements, prior to completing an order, you are required to open an online account this is only required on first instance and can be used again for future purchases, Please note the address you supply us must be the same as that held by the payment card company. We reserve the right to cancel any order which we feel may have been placed illegally and or fraudulently. To prevent fraud we reserve the right to delay the processing any order whilst security checks are undertaken on either the Invoice Address and/or Delivery Address and/or Payment Method and/or Contact Details and/or Any Other related Information, this may effect export orders in particular. We may or may not contact you whilst this/these check (s) are being undertaken, should we contact you we may require further information about you to complete the order under investigation. Please note we now report all fraud to the British Police and other related overseas Police forces and or any related financial institutions.
Clause 5
UK Orders
Apart from special orders, sold out/discontinued articles and spare parts etc (see Clause 2), goods purchased from us may be returned within 7 #working days of receipt for a refund or replacement for same, providing you have notified us in writing of your intention to return items in person, by post, by fax or by e-mail within these 7 #working days. The goods must be returned to the above address and the cost of packing and returning any goods will be at the customer's expense. Please use a suitable service when returning goods, as we cannot be held responsible for any returned goods lost or damaged in transit. We must receive goods within 14 #working days of receipt of you notifying us, and any goods returned must be received by us in the condition they where received by the customer. Sealed boxes and packages such as plastic or metal kits must be unopened, clear bags with header cards must be intact, (a good guideline is that you may do no more with the goods than you would be able to do when examining or buying goods over the counter in a shop). A full refund will be made within 21 #working days of the goods being received back by us, less any carriage charge, where carriage was offered free of charge or collection requested, a charge of £10.00 will be levied to cover extra administration costs, providing that all previous conditions are observed. This condition does not affect your rights on the return of faulty goods.
Clause 5A
Export Orders
Export orders are not refundable or returnable and or exchangeable under any circumstances. Export relates to any destination outside of the territories of Northern Ireland, Scotland, Wales and England. otherwise known as the UK.
Clause 6
Any details we have on record about you will be used only by Keay Group Investments and will not be passed on or sold to any other parties. If you have requested us to do so we will occasionally e-mail you details of special offers, promotions or new price lists.
